Terms of Service

This page is maintained by Mattic RX to answer common legal questions about our platform and services.

1. Acceptance of These Terms

These Terms of Service (the “Terms”) are a binding agreement between you and MatticRX (“MatticRX,” “we,” “us,” or “our”). They govern your access to and use of www.matticrx.com, related websites, applications, patient portals, communications, content, products, and non-clinical support services that reference these Terms (collectively, the “Platform”).

By creating an account, clicking to accept, purchasing a service, or using the Platform, you confirm that you have read and agree to these Terms, our Privacy Policy, and any additional consent, notice, program, or purchase terms presented to you. If you do not agree, do not use the Platform. If you use the Platform for another person, you represent that you have legal authority to act for that person and that person is also bound by these Terms.

2. Emergency and Urgent Care

THE PLATFORM IS NOT AN EMERGENCY SERVICE. IF YOU THINK YOU MAY HAVE A MEDICAL EMERGENCY, CALL 911 OR GO TO THE NEAREST EMERGENCY DEPARTMENT. DO NOT WAIT FOR A MESSAGE OR RESPONSE THROUGH THE PLATFORM.

The Platform is not appropriate for every condition and is not a substitute for an in-person examination, emergency care, or an ongoing relationship with a primary care clinician. Seek prompt in-person care when directed by a clinician or when your symptoms worsen or require immediate attention.

3. MatticRX and the Clinical Providers

MatticRX provides technology, care-navigation, payment, customer-support, and other administrative services. Professional medical services are provided only by independently licensed physicians and other clinicians (each a “Provider”) through the third-party medical group engaged to support the Services (the “Medical Group”). MatticRX is not the Medical Group and does not direct or control a Provider’s independent clinical judgment. The identity and credentials of the applicable Provider will be disclosed in connection with your care.

A Provider–patient relationship is established only when a Provider accepts you for care as permitted by applicable law. General website content, eligibility questions, account creation, payment, or communications with non-clinical personnel do not establish that relationship. Providers alone determine whether evaluation, treatment, testing, or a prescription is clinically appropriate. MatticRX does not guarantee that you will qualify for any treatment or receive a prescription.

Pharmacy, laboratory, diagnostic, fulfillment, and shipping services may be provided by separately licensed third parties (“Healthcare Partners”). Each Healthcare Partner is responsible for the services it performs. Their additional terms, notices, and policies may apply.

4. Telehealth Services and Consent

The Platform may facilitate care through synchronous video or audio visits, asynchronous questionnaires and secure messaging, remote monitoring, or other lawful telehealth methods. Telehealth has benefits, including convenience and access, and limitations, including potential technology failures, incomplete information, privacy risks, and the possibility that an in-person examination or additional testing will be necessary.

By requesting telehealth services, you consent to the use of telehealth and electronic communications, subject to any separate state-specific telehealth consent. You may withdraw consent as allowed by law, but doing so may limit our ability to provide services. You must provide complete and accurate health information, disclose medications and allergies, follow treatment instructions, and promptly report material changes or adverse effects. You remain responsible for maintaining care with appropriate local clinicians and for obtaining emergency or in-person services when needed.

5. Eligibility, Location, and Identity

You must be at least 18 years old, legally capable of entering a contract, and physically located in the United States in a jurisdiction where the applicable Provider is licensed and the requested service is lawfully available. MatticRX’s physician and pharmacy networks support all 50 states. However, certain medications or treatments may not be prescribed, dispensed, or shipped to particular states because of federal or state requirements, Provider judgment, pharmacy availability, or other legal restrictions. MatticRX, the Medical Group, Providers, and pharmacies follow applicable federal and state laws. You may be asked to confirm your location at each encounter. Do not access clinical services while outside the United States or where a requested service is not lawfully available.

You agree to provide truthful, current, and complete identity, contact, payment, and health information. We or our service providers may verify your identity, age, and location. You may not impersonate another person, create an account for someone else without lawful authority, or obtain medication for resale or use by another person.

6. Accounts and Platform Security

Your account is personal to you. Keep your login credentials confidential, use reasonable security safeguards, and notify us promptly at support@mattichealth.com or 925-501-5814 if you suspect unauthorized access. You are responsible for activity conducted through your account unless prohibited by law. We may suspend or restrict access to protect patients, Providers, the Platform, or others; investigate suspected misuse; comply with law; or address nonpayment.

7. Prescriptions, Medications, and Compounded Products

A prescription is issued only when a licensed Provider determines, in the Provider’s independent professional judgment, that it is medically appropriate and lawful. Completing an intake, paying a fee, or previously receiving a medication does not guarantee a prescription, refill, particular dose, or treatment duration. A Provider may require laboratory testing, an in-person visit, additional records, monitoring, or referral before prescribing or continuing treatment.

Prescriptions may be transmitted to a licensed pharmacy selected by you or identified through the Platform, as permitted by law. Dispensing, substitutions, packaging, delivery, counseling, and pharmacy services are the pharmacy’s responsibility. Delivery dates are estimates, and you must promptly inspect shipments and follow storage instructions.

If a Provider prescribes a compounded medication, you acknowledge that compounded drugs are prepared for an individual patient based on a prescription and are not approved by the U.S. Food and Drug Administration (“FDA”). The FDA does not review compounded drugs for safety, effectiveness, or quality before marketing. Compounded medication may be prescribed only when the Provider determines it is appropriate and legally available. Brand names may be used only to identify an active ingredient or therapeutic category and do not imply that a compounded product is the FDA-approved branded drug or that MatticRX is affiliated with the brand owner.

Never share, transfer, or resell prescription medication. Use medication only as directed. Contact your Provider about side effects or treatment questions, and seek emergency care for severe symptoms.

Research-Use-Only Peptides

Certain peptides displayed or offered separately through MatticRX may not be approved by the U.S. Food and Drug Administration (“FDA”) and may be labeled strictly for research use only. Research-use-only products are not intended for human or veterinary consumption, administration, diagnosis, treatment, cure, mitigation, or prevention of disease, and are not represented as safe or effective for any medical purpose.

Research-use-only products are separate from clinical Services and are not prescriptions, compounded medications for patient treatment, or substitutes for FDA-approved products. A Provider–patient relationship does not authorize human use of a research-use-only product. You may not ingest, inject, administer, resell for human use, or otherwise use a research-use-only product in or on humans or animals. Product labeling and applicable federal, state, and local laws must be followed at all times.

A “research use only” label does not make the sale or distribution of a product lawful if the product is marketed, promoted, or intended for human use. MatticRX reserves the right to refuse or cancel a research-product transaction when it believes the order may involve human use, unlawful conduct, resale, diversion, or another prohibited purpose.

8. Fees, Payment, Insurance, and Taxes

Prices and included services are disclosed at checkout or in the applicable program terms. You authorize MatticRX and its payment processors to charge the payment method you provide for amounts you approve, including applicable taxes and recurring charges described before enrollment. You represent that you are authorized to use the payment method and agree to keep payment information current.

Unless expressly stated otherwise, services are self-pay and are not billed to commercial insurance, Medicare, Medicaid, or other government programs. MatticRX, the Medical Group, and Healthcare Partners do not guarantee reimbursement. You are responsible for determining whether you may use health savings, flexible spending, or other benefit funds and for all amounts not paid by a third party.

The displayed price includes the consultation, prescribed medication, and shipping unless the order page expressly states otherwise. Laboratory work depends on the medication and treatment plan and will be identified with the applicable order. Additional blood panels are separate purchases, are listed separately on the Platform, and may be requested or approved by a Provider. You are responsible for the price displayed and accepted before purchase.

9. Subscriptions, Renewal, and Cancellation

If you enroll in a subscription or membership, the checkout page will state the recurring price, billing interval, minimum commitment (if any), what is included, and how to cancel. By enrolling, you authorize recurring charges to your payment method until cancellation becomes effective. We will provide any renewal notices required by law.

To cancel an automatic-renewal order, you must notify MatticRX by call, text, or email at 925-501-5814 or support@mattichealth.com before the medication order is shipped. A cancellation is effective only after MatticRX confirms it. If the medication order has already entered pharmacy processing and can no longer be stopped, or has shipped, the order is final and is not refundable except for a verified damaged or lost shipment as described in Section 10. Cancellation stops future renewals but does not reverse a prescription or pharmacy order that can no longer be stopped. Any price change will be communicated as required by law before it applies. If payment fails, we may retry the charge, request another payment method, or pause non-emergency services.

10. Refunds, Returns, and Delivery

ALL SALES ARE FINAL ONCE AN ORDER CAN NO LONGER BE STOPPED DURING PHARMACY PROCESSING OR HAS SHIPPED. PRESCRIPTION MEDICATIONS AND OTHER PATIENT-SPECIFIC PRODUCTS MAY NOT BE RETURNED. EXCEPT WHERE REQUIRED BY LAW OR FOR A VERIFIED DAMAGED OR LOST SHIPMENT, MATTICRX DOES NOT PROVIDE RETURNS, REFUNDS, CREDITS, OR EXCHANGES, INCLUDING FOR UNUSED OR UNOPENED PRODUCTS. An automatic-renewal cancellation is governed by Section 9 and does not create a right to a refund for an order that can no longer be stopped or has shipped.

Contact support@mattichealth.com or 925-501-5814 promptly regarding a shipment that is lost or arrives damaged. Upon verification, MatticRX may, as appropriate, arrange a replacement at no additional charge or issue a refund for the affected order. Do not use a product that appears damaged, altered, or improperly stored until the dispensing pharmacy or a Provider gives instructions.

11. Communications and Electronic Records

You consent to receive transactional electronic communications necessary to administer your account and care, including appointment, billing, prescription, shipment, laboratory, security, and Provider messages. You are responsible for monitoring your account and contact channels and for keeping them current. Standard carrier charges may apply.

By providing a telephone number or email address, you authorize MatticRX, the Medical Group, Providers, pharmacies, laboratories, fulfillment partners, and service providers acting on their behalf to contact you about your account, care, appointments, orders, prescriptions, laboratory work, billing, security, and shipping. These operational communications are part of the Services and may be sent by call, text, email, portal message, or other electronic means, as permitted by law. Message and data rates may apply.

When you provide the required consent during checkout, you authorize MatticRX to send marketing or promotional calls and text messages as described in the checkout disclosure, including messages sent using regulated automated technology or an artificial or prerecorded voice. Marketing consent is not a condition of receiving care or making a purchase. Message frequency varies. Message and data rates may apply. Reply STOP to revoke text-message consent and HELP for help, or contact support@mattichealth.com or 925-501-5814. Carriers are not liable for delayed or undelivered messages. Electronic signatures and records have the same effect as paper versions to the extent permitted by law.

12. Privacy and Health Information

Our Privacy Policy, available at www.matticrx.com/privacy-policy, explains how MatticRX collects, uses, and shares information in its own capacity. The Medical Group is an independent healthcare affiliate and is responsible for its own Notice of Privacy Practices describing how it and its Providers handle protected health information under the Health Insurance Portability and Accountability Act (“HIPAA”) and other applicable health-privacy laws. The Medical Group’s Notice of Privacy Practices is separate from MatticRX’s policies and is provided by the Medical Group as required by law.

HIPAA does not apply to every type of health-related information or every entity. We will not use these Terms to expand or reduce rights or duties imposed by applicable privacy law. If these Terms conflict with an applicable Notice of Privacy Practices regarding protected health information, the Notice of Privacy Practices controls for that information.

13. Informational Content; No Guarantees

Content available outside an individual clinical encounter is for general educational purposes. It is not medical advice, diagnosis, or treatment and should not be used as a substitute for advice from a qualified clinician who knows your circumstances. Do not delay or disregard professional care because of Platform content.

Health outcomes vary. We do not promise a particular diagnosis, prescription, weight change, hormone level, symptom improvement, or other outcome. Testimonials and examples describe individual experiences and are not guarantees. Product and service descriptions are not claims that a treatment is safe or effective for every person.

14. Acceptable Use

You may use the Platform only for lawful, personal, non-commercial purposes. You may not: interfere with security or operation; probe or bypass access controls; introduce malicious code; scrape or harvest data; reverse engineer the Platform except where law prohibits restriction; use bots or automated means without permission; upload unlawful, deceptive, infringing, or harmful material; harass Providers, staff, or others; misuse prescriptions; or use the Platform for fraud, resale, diversion, or any unlawful healthcare activity.

15. Intellectual Property and Feedback

The Platform and its content, software, design, trademarks, and other materials are owned by MatticRX or its licensors and protected by law. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to use the Platform for personal purposes. No other rights are granted. You may not use MatticRX names, logos, or branding without written permission.

If you voluntarily submit suggestions or feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use it without restriction or compensation, provided that we will handle personal information in accordance with applicable privacy law.

16. Third-Party Services and Links

The Platform may link to or interoperate with independent websites, pharmacies, laboratories, payment processors, identity-verification vendors, delivery services, and other third parties. We do not control their services or terms. A link or integration does not constitute endorsement. To the extent permitted by law, your dealings with a third party are between you and that third party.

17. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, YOUR USE OF THE PLATFORM AND NON-CLINICAL SERVICES IS AT YOUR SOLE RISK. THE PLATFORM, NON-CLINICAL SERVICES, AND GENERAL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” MATTICRX DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OPERABILITY, ACCURACY, AND SYSTEM INTEGRATION. MATTICRX DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

MATTICRX DOES NOT GUARANTEE THAT A PROVIDER WILL PRESCRIBE ANY MEDICATION OR CONTINUE ANY TREATMENT. PROVIDERS EXERCISE INDEPENDENT CLINICAL JUDGMENT. YOU ARE RESPONSIBLE FOR USING MEDICATION ONLY AS DIRECTED, FOLLOWING WARNINGS AND TREATMENT INSTRUCTIONS, AND SEEKING APPROPRIATE CARE. MISUSE OF A PRESCRIPTION MAY CAUSE SERIOUS OR UNEXPECTED CONSEQUENCES.

If applicable law does not permit a particular warranty disclaimer, the scope and duration of that warranty will be limited to the minimum required by law. Nothing in these Terms eliminates a Provider’s professional duties or applicable standard of care.

18. Limitation of Liability

EXCEPT WHERE THE LAW PROVIDES OTHERWISE, MATTICRX IS NOT RESPONSIBLE FOR THE INDEPENDENT ACTS OR OMISSIONS OF THE MEDICAL GROUP, INDIVIDUAL PROVIDERS, PHARMACIES, LABORATORIES, SHIPPING CARRIERS, OR OTHER INDEPENDENT HEALTHCARE PARTNERS.

TO THE FULLEST EXTENT PERMITTED BY LAW, MATTICRX, THE MEDICAL GROUP, THE PROVIDERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF REVENUE, PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE PLATFORM, SERVICES, OR THESE TERMS, WHETHER THE CLAIM IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY, STATUTE, OR ANOTHER LEGAL THEORY.

MatticRX does not guarantee that Platform content, service descriptions, third-party content, or other information is complete, current, or error-free. We may change Platform content or functionality without notice. MatticRX is not responsible for your internet connection, device, mobile signal, or data service. These limitations apply only to the extent permitted by law and do not limit liability that applicable law does not allow to be limited.

19. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless MatticRX and its affiliates, officers, directors, employees, and agents from third-party claims, losses, damages, liabilities, penalties, and reasonable costs, including reasonable attorneys’ fees, arising from your unlawful use or misuse of the Platform or Services, information you submit through the Platform, material breach of these Terms or the Privacy Policy, infringement of another person’s rights, fraud, or negligent or wrongful conduct. This obligation does not apply to the extent a claim results from an indemnified party’s own negligence, willful misconduct, or violation of law.

20. Suspension and Termination

You may stop using the Platform at any time, subject to payment obligations and program cancellation terms. We may suspend or terminate Platform access for violation of these Terms, safety concerns, unlawful conduct, fraud, nonpayment, or discontinuation of a service. Ending Platform access does not automatically terminate an established Provider–patient relationship; the Medical Group will handle clinical termination, continuity-of-care obligations, records, and notice as required by law.

21. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

Except where prohibited by law, any dispute arising under or relating to these Terms, the Platform, or the Services will be resolved exclusively by final and binding individual arbitration in Wyoming under the applicable rules of the American Arbitration Association. Either party may bring a claim concerning intellectual property rights, or seek temporary or preliminary injunctive or equitable relief, in a court of competent jurisdiction.

ALL CLAIMS, WHETHER IN ARBITRATION OR OTHERWISE, MUST BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. If applicable law prevents enforcement of a portion of this section, that portion will be limited to the minimum extent necessary, and the remainder will continue in effect.

22. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. Any court proceeding permitted under these Terms will be subject to the personal and subject-matter jurisdiction of the state and federal courts located in Wyoming, unless applicable consumer law requires another forum. You are responsible for complying with the laws that apply where you access or use the Platform.

23. Changes to the Platform or These Terms

We may update the Platform and these Terms. The “Last Updated” date shows when the Terms were revised. If a change is material, we will provide notice as required by law and request renewed acceptance when appropriate. Changes apply prospectively from their effective date. Continued use after the effective date constitutes acceptance where permitted by law; if you do not agree, you must stop using the affected service and cancel recurring services before the next renewal.

24. General Terms

These Terms and incorporated service-specific terms are the entire agreement concerning the Platform. If a service-specific term conflicts with these Terms, the more specific term controls for that service. If a provision is unenforceable, it will be modified only as much as necessary and the remainder stays effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, financing, reorganization, sale of assets, or by operation of law, subject to applicable law. Headings are for convenience only. Provisions that by their nature should survive termination will survive.
